Isn't it considered an invasion of privacy to do a background check on somebody?

No, a typical background check is conducted using public information. It's your right to use this type of information to protect yourself. By the way, you're probably having backgrounds run on you all the time without knowing it. Every time you apply for a credit and/or an insurance policy or a job, you can bet that a background investigation, including a credit check, is done on you.
